Due to the recent increased level of pipeline construction, much attention has been paid to how pipeline safety is overseen by regulatory agencies. PHMSA has been granted authority by Congress to develop, implement and enforce regulations that will ensure the safe operation of pipelines. Individual states can secure agreements with PHMSA to enforce the regulations through formal Memorandums of Understanding (MOUs). Each state’s program can be tailored to different types of facilities. For example, if a state agency only seeks to audit and enforce the regulations for certain types of pipelines, PHMSA will take over for any section of the regulations that is not overseen by the state. States that have secured this authority with PHMSA may also adopt their own pipeline safety standards, but they must be consistent with PHMSA regulations.
